Course Manuals and Curriculum
HYA course manuals, teaching materials, lesson descriptions, presentations and proprietary educational content are intended solely for authorized students and instructors according to applicable course terms.

It prohibits unauthorized exploitation to the extent protected by copyright, trademark, privacy, publicity, passing-off, contract, unfair-competition and related laws.

India's Digital Personal Data Protection Act, 2023 and DPDP Rules, 2025 are being implemented on a phased commencement schedule. HYA will apply those requirements as and when they become legally applicable. MeitY

- photographer credits;
- digital watermarks;

No False Copyright Ownership
No third party may knowingly claim authorship or ownership of HYA-owned works where doing so violates applicable law.
This includes submitting fraudulent copyright claims against HYA's own original material.
Legal Exceptions and Fair Use/Fair Dealing
Nothing in this Policy is intended to remove rights that applicable law expressly grants to the public.
For example, India's Copyright Act recognizes certain fair-dealing exceptions, including qualifying private/research use, criticism/review and reporting of current events. Copyright Office of India
United States copyright law similarly recognizes fair use under 17 U.S.C. §107 based on factors including purpose, nature, amount used and market effect. U.S. Copyright Office
Accordingly, HYA's requirement for written permission applies except where applicable law independently authorizes the specific use.
Nothing in this Policy is intended to suppress lawful journalism, criticism, review, research, commentary or other protected activity.

Failure by HYA to discover infringement immediately does not create authorization or ownership in the infringer.

IMPORTANT MONETARY LIABILITY WARNING
Unauthorized commercial exploitation can create substantial financial liability.
Where legally supported by the nature, scale and jurisdiction of an infringement, Himalayan Yoga Association®/ Himalayan Yoga Ashram® reserves the right to pursue claims and monetary relief whose aggregate value may range from USD 100,000 to USD 1,000,000 or more, particularly where conduct involves multiple protected works, repeated infringement, willful infringement, counterfeit branding, substantial commercial profits, consumer deception, multiple domains, reputational damage or continuing violations after notice.
This amount is NOT an automatic fine.
The USD 100,000–USD 1,000,000 range is an enforcement warning regarding potential claims and exposure, not a representation that every unauthorized use automatically creates a debt in that amount.
Any damages, profits, penalties, statutory damages, costs or other monetary remedies depend upon:
- applicable law;
- ownership and registration;
- number of works/marks involved;
- jurisdiction;
- evidence;
- actual losses;
- profits;
- willfulness;
- contractual obligations;
- registration timing;
- and the decision of the competent court, tribunal or authority.
This distinction is important because courts—not a website notice—determine statutory fines or damages.
United States Copyright Remedies
Where United States law applies, 17 U.S.C. §504 permits recovery of actual damages and attributable profits or, where available, statutory damages.
Statutory damages generally range from:
USD 750 to USD 30,000 per copyrighted work
and may reach:
up to USD 150,000 per work for willful infringement
where statutory requirements are satisfied. U.S. Copyright Office
Because multiple works can be infringed simultaneously, total exposure in a serious copying operation can therefore potentially exceed USD 1,000,000.
Timely U.S. copyright registration is particularly important for eligibility for certain statutory damages and attorneys' fees. 17 U.S.C. §412 restricts those remedies where registration timing requirements are not satisfied. U.S. Copyright Office
United States Trademark Remedies
Where applicable, HYA may rely on U.S. trademark and unfair-competition principles under the Lanham Act, including claims relating to registered marks, false designation of origin, false affiliation and cybersquatting.
For qualifying counterfeit-mark cases, U.S. statutory damages can reach up to USD 2,000,000 per counterfeit mark per type of goods or services in willful cases.
For qualifying Anti-Cybersquatting Consumer Protection Act violations, statutory damages can range from USD 1,000 to USD 100,000 per domain name. Legal Information Institute
These remedies are awarded according to applicable statutory requirements and judicial determination.
Indian Copyright Law
HYA reserves rights available under the Copyright Act, 1957, as amended.
Depending upon the circumstances, infringement may permit civil remedies including:
- injunction;
- damages;
- account of profits;
- and other relief available under Section 55.
Section 58 also addresses rights regarding infringing copies. Copyright Office of India
For qualifying knowing infringement, Section 63 provides criminal consequences including imprisonment and fines within the statutory range. Repeat convictions may attract enhanced consequences under Section 63A. Section 64 provides certain police seizure powers for infringing copies where statutory requirements are satisfied. Copyright Office of India
HYA does not represent that criminal liability applies to every copyright dispute; the statutory requirements must be satisfied.
Indian Trademark and Passing-Off Law
HYA reserves all rights available under the Trade Marks Act, 1999, including where applicable:
- infringement of registered marks;
- passing off;
- deceptive similarity;
- use of marks as trade/business names;
- confusing advertising;
- injunctions;
- damages;
- account of profits;
- delivery-up/destruction;
- and other available relief.
Sections 27, 28, 29 and 135 are particularly relevant to these rights and remedies. IP India
Sections 102–105 also establish criminal provisions for specified false-trademark conduct where their statutory requirements are satisfied. IP India
Online Impersonation and Fraud
Where a third party goes beyond ordinary IP infringement and uses online systems to commit qualifying identity theft, cheating by personation or fraud, HYA reserves the right to refer the matter to competent law-enforcement or cybercrime authorities.
Sections 66C and 66D of India's Information Technology Act address certain forms of identity theft and cheating by personation through computer resources. MeitY
Their application depends upon the actual facts and statutory requirements.
Domain-Name Enforcement
Where a domain is identical or confusingly similar to an HYA trademark or service mark and the requirements are otherwise satisfied, HYA may seek cancellation or transfer under:
ICANN UDRP
or other applicable country-code dispute procedures.
Under the UDRP, the complainant must generally prove:
- trademark/service-mark rights and confusing similarity;
- absence of legitimate rights/interests by the respondent; and
- registration and use in bad faith.
Evidence Preservation
HYA may preserve evidence of suspected infringement including:
- screenshots;
- archived webpages;
- timestamps;
- WHOIS/registration records;
- DNS records;
- hosting information;
- source code;
- HTML;
- advertisements;
- payment pages;
- social posts;
- emails;
- WhatsApp communications;
- student complaints;
- Google search results;
- invoices;
- enrolment forms;
- and other relevant materials.
Evidence may be shared with lawyers, courts, registrars, hosting providers, platforms, law enforcement and competent authorities as permitted by law.
Repeat Infringers
Repeat infringement after receiving notice may be treated as evidence relevant to willfulness, knowledge, bad faith or intentional conduct where applicable law permits such inference.
HYA may escalate repeat violations without providing unlimited additional warnings.
Third-Party Content
Certain materials displayed by HYA may belong to third parties and may be used under licence, permission or applicable law.
HYA does not claim ownership of third-party rights merely because the material is displayed on its website.
Third-party marks remain the property of their respective owners.
